Terms and Conditions

These conditions supplement the German Forwarders' Standard Terms and Conditions (ADSp 2017) for orders placed through the online booking flow of ISG Express Logistik GmbH. The legally binding text is the German original below. Version: May 2026.

§ 1 Scope of Application and Contracting Parties

(1) These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded between ISG Express Logistik GmbH, Zillenhardtstraße 41, 73037 Göppingen (hereinafter "ISG"), and the client via the online booking process at www.isg-express.com (hereinafter the "Platform").

(2) In addition, the German Freight Forwarders' Standard Terms and Conditions 2017 (Allgemeine Deutsche Spediteurbedingungen, ADSp 2017) shall apply in their respective valid version. They are available at www.dslv.org and will be provided to the client free of charge at any time on request. In the event of contradictions, the provisions of these GTC shall take precedence over the ADSp 2017.

(3) The Platform is directed exclusively at entrepreneurs within the meaning of § 14 BGB (German Civil Code). By making a booking, the client confirms that it is acting in the exercise of its commercial or self-employed professional activity.

§ 2 Conclusion of Contract

(1) The presentation of services and prices on the Platform does not constitute a binding offer, but an invitation to the client to submit an offer.

(2) By confirming the booking in the final step of the booking process, the client submits a binding offer. The contract is concluded upon receipt of the order confirmation from ISG by e-mail.

(3) In the case of bookings with immediate payment, the contract is concluded upon successful charging of the means of payment.

§ 3 Fixed Price and Additional Services

(1) The fixed price stated in the booking confirmation is binding, provided that the shipment data given in the booking (dimensions, weight, number of packages, loading and unloading point, times) are correct and complete.

(2) If it emerges at the time of collection that the actual shipment deviates from the information provided (in particular in the case of excess weight, greater volume, additional stops or altered time windows), ISG reserves the right to adjust the price accordingly or to refuse carriage. The client will be informed in advance.

(3) Waiting times at the place of loading or unloading for which ISG is not responsible will be charged at EUR 60.00 net per hour commenced after the first 30 minutes have elapsed.

§ 4 Obligations of the Client

(1) The client is obliged to describe the shipment truthfully and completely (contents, dimensions, weight, particular characteristics).

(2) The shipment must be packaged so as to be safe for transport. Damage or additional expense arising from inadequate packaging (in particular repackaging, return shipment) shall be borne by the client.

(3) Dangerous goods (ADR) must be identified as such at the time of booking. The carriage of undeclared dangerous goods is prohibited and entitles ISG to terminate the contract without notice.

§ 5 Excluded Goods

Excluded from carriage are in particular: cash, securities, precious metals, jewellery with a unit value exceeding EUR 1,000, works of art with a unit value exceeding EUR 5,000, live animals, human remains, narcotics, weapons and ammunition outside the legally permitted carriage, radioactive substances, highly perishable foodstuffs as well as all goods whose carriage contravenes applicable law. A complete list of the excluded goods is available at www.isg-express.com/verbotene-gueter.

§ 6 Cancellation by the Client

(1) Cancellation is free of charge as long as the collection is more than 4 hours in the future.

(2) In the event of cancellation between 4 hours and 1 hour before the agreed collection time, a cancellation fee amounting to 50 % of the fixed price becomes payable.

(3) In the event of cancellation less than 1 hour before the agreed collection time or after the vehicle has arrived at the place of collection, the full fixed price becomes payable.

(4) Cancellations must be made in text form (an e-mail to service@isg-logistik.de is sufficient).

§ 7 Payment

(1) Payment is made at the client's choice during the booking process: by credit card, Apple Pay, Google Pay, Klarna, PayPal, SEPA direct debit or, subject to a credit check, by invoice.

(2) In the case of immediate payment, the amount is charged upon conclusion of the contract. In the case of payment by invoice, the amount is due within 14 days of the date of invoice without deduction.

(3) In the event of default in payment, ISG is entitled to claim default interest at the statutory rate as well as a flat-rate reminder fee pursuant to § 288 (5) BGB (German Civil Code) in the amount of EUR 40.00 per reminder.

§ 8 Liability

(1) ISG's liability for damage to the shipment is governed by the ADSp 2017. Ordinary liability is limited to 8.33 Special Drawing Rights (SDR) per kilogram of damaged or lost goods, but no more than EUR 1.25 million per claim event (Clause 23 ADSp 2017).

(2) The client may obtain liability beyond this by agreeing a declaration of value or by taking out transport insurance. On request, ISG will arrange appropriate insurance.

(3) In cases of intent and gross negligence, ISG is liable without limitation.

(4) Liability for indirect damage, loss of profit and consequential damage is excluded unless there is intent or gross negligence.

§ 9 Data Protection

ISG processes the client's personal data exclusively for the performance of the contract and within the framework of the statutory requirements. Details can be found in the Privacy Policy at www.isg-express.com/datenschutz.

§ 10 Place of Performance, Place of Jurisdiction and Applicable Law

(1) The place of performance for all obligations arising from the contractual relationship is Göppingen.

(2) The exclusive place of jurisdiction for all disputes arising from this contractual relationship is Göppingen, provided that the client is a merchant, a legal entity under public law or a special fund under public law. ISG is also entitled to bring an action against the client at the client's general place of jurisdiction.

(3) The law of the Federal Republic of Germany applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

§ 11 Final Provisions

(1) Amendments and additions to these GTC as well as ancillary agreements must be made in text form.

(2) Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The statutory provision shall take the place of the invalid provision.
